Bankruptcy

In the real world, it is very rare for a professional to guarantee his or her work. If you hire a doctor or an attorney you generally do not get a guarantee. However, when I do your bankruptcy, I take responsibility for my work.
Technically, I cannot guarantee what the Court will or will not do. However, I can and do guarantee that if I accept you as a Client and submit your bankruptcy petition to the court, the court will:

  1. Accept your petition; and
  2. Issue you a discharge. Consequently, if the Court denies you a discharge for any reason, I take responsibility and either fix the problem, at no cost to you, or give you a full refund.

The inherent restrictions on the above guarantee are that you:

  1. Be fully honest,
  2. Disclose all required information,
  3. Complete the two required counseling sessions; and
  4. Attend the mandatory Meeting of Creditors.

If you conform to these restrictions, you can unburden yourself and leave the rest to me.

Chapter 7

Chapter 7 of the United States Bankruptcy Code is the Code's "liquidation" chapter. Lawyers sometimes refer to it as a "straight bankruptcy." It is used primarily by individuals who wish to free themselves of debt quickly, simply and inexpensively, but may also be used by businesses that wish to liquidate and terminate their business.

Chapter 13

Chapter 13 of the United States Bankruptcy Code is designed for individuals with regular income who desire to save property, usually a residence, or who do not qualify for Chapter 7. The purpose of chapter 13 bankruptcy is to enable financially distressed individual debtors, under court supervision and protection, to propose and carry out a repayment plan under which creditors are paid over an extended period of time. Under this chapter, debtors are permitted to repay creditors, in full or in part, in installments over a three to five year period, during which time creditors are prohibited from starting or continuing collection efforts.
